Federal Mine Safety and Health Review Commission

The Federal Mine Safety and Health Review Commission (FMSHRC) provides administrative trial and appellate review of legal disputes arising under the Federal Mine Safety and Health Amendments Act of 1977. It does not regulate mining or enforce the Mine Act. The FMSHRC Website contains the following information:

  • Rules provides Commission procedural rules, ethical conduct standards for Commission employees, and enforcement of nondiscrimination in programs or activities conducted by the Commission.
  • FMSHRC also provides Recent Decisions which contains Commission and Administrative Law Judges (ALJ) decisions in pdf/html formats, plus a list of Commission cases pending in the Court of Appeals or that have been decided this fiscal year. Published Decisions contains Commission decisions and ALJ decisions 1995-2003 in text/pdf or html/pdf format. The database is searchable or browsable with documents arranged in chronological order from oldest to most recent.
  • What's New contains FMSHRC news releases and the Commission's schedule for meetings and oral arguments. This page also contains oral argument transcripts when available.
  • FMSHRC also links to the Mine Safety and Health Administration (MSHA) Web page on Statutory and Regulatory Information containing links to Federal Register documents, transcripts of public hearings, compliance assistance information and the Federal Mine Safety and Health Act of 1977.
